The confidentiality of your personal data represents one of the main concerns of N&I Medical Advertising SRL (the “Owner”), a limited liability company organized and functioning under Romanian laws, having its registered office in Bucharest, sector 3, 240 Calea Călărași, building 76, entrance 1, ground floor, apartment 2, acting as data controller.
This document is intended to inform you on the processing of your personal data in the context of your use of the www.medicalbusinesspress.com internet site (the “Site”). We note that this document contains specific provisions applicable to healthcare professionals.

- your phone’s advertising identifier;
- information on the used device, including its sole identification code, the hardware model, the operation system and its version, as well as information on the mobile network used by you;
- your answers to surveys in which you chose to participate, including your answers to surveys related to diseases or the practice (for instance, the number of patients suffering from a particular disease examined by you);
- your interests (your health condition and topics on which you look for information through the Site or in which you are interested);
- information on the use by you of the products presented on the Site and on your interactions with the Owner.
We may also collect Personal Data from other sources, including from companies handling databases accessible to the public, associated marketing partners, social platforms and other third parties.

Purposes and grounds for processing
If you are a user of the Site, the Owner processes your personal data as follows:
- for compliance with the legal obligation incumbent on the Owner in the context of the services provided through the Site, including with tax-related obligations and archiving obligations.
The processing of your data for this purpose is required based on legal obligations. The providing of your data is required for this purpose. Your refusal to provide us with your data can lead to the Owner’s inability to comply with the legal obligations incumbent on it and, therefore, to its inability to provide you the services through the Site.
- for marketing activities, i.e. in order to send you, through remote communication means (e-mail, SMS), commercial communications on the products and services offered by the Owner through the Site.
The processing of your data for this purpose is based on your consent, if you choose to give it.
You can give your consent to the processing of data for this purpose by checking the corresponding box at the time of or after the account creation in your own account. In order for you to unsubscribe from receiving such commercial messages, you can use the option located at the end of each e-mail/SMS containing commercial communications. The processing of your data for this purpose is based on the Owner’s legitimate interest to secure the proper operation of the Site, and to permanently improve the experience of visitors of the Site, including by the settlement of various comments, queries, or complaints.
The providing of your data for this purpose is voluntary. Your refusal to provide us with your data for this purpose will not have negative consequences for you.
Duration of data processing
In principle, the Owner will process your personal data as long as this is necessary for the achievement of the aforementioned processing purposes.
If you withdraw your consent to the processing of data for marketing purposes, the Owner will terminate such processing of your personal data for this purpose. Yet, the processing performed by the Owner based on your consent given by you prior to its withdrawal will not be affected.
Disclosure of personal data
For the attainment of processing purposes, the Owner may disclose your personal data to partners, to third parties or to entities supporting the Owner in performing its activities through the Site whenever any central/local public authorities, such as: agencies and our suppliers, our professional advisors and auditors, our subsidiaries and business partners, regulatory authorities, governments and law enforcement authorities, courts of law, tribunals, arbitrators and other judicial bodies, and to third parties in relation to the sale, purchase, merger, reorganization, in full or in part, of our business or to any change in our business, in the following cases, which are listed indicatively:
- for the Site administration;
- in situations where such disclosure is necessary for the award of prizes or other facilities to data subjects obtained as a result of their participation in various promotional campaigns organized by the Owner through the Site;
- in order to maintain, customize and improve the Site and the services offered through it;
- in order to conduct data analyses, tests and researches, to monitor the use and business trends, to develop safety features and for the authentication of users;
- in order to send marketing commercial communications, under the terms and within the limits provided for by law;
- when the disclosure of personal data is required by law etc.
Transfer of personal data
Personal data provided to the Owner may be transferred outside Romania, but only to European Union member states.
Rights from which you benefit
Under the terms set forth by the legislation in the personal data processing area, as data subject, you benefit from the following rights:
(a) the right to information, i.e. the right to receive details regarding the processing operations performed by the Owner as described in this Privacy Policy;
(b) the right to access to data, i.e. the right to receive a confirmation from the Owner on the processing of your personal data, as well as details on the processing operations and on the way in which data is processed, the purpose of the processing, the data recipients or categories of data recipients etc.;
(c) the right to rectification, i.e. the right to have your inaccurate/unjustified personal data corrected and your incomplete data supplemented by the Owner with no undue delays;
Such rectification/supplementing will be communicated to each recipient to which data was transmitted, except for cases where this proves to be impossible or requires disproportionate efforts.
(d) the right to data erasure with no undue delays, („the right to be forgotten”), in situations where one of the following reasons applies:
- data is no longer necessary for the attainment of the purposes for which it was collected or processed;
- in cases where your consent is withdrawn and there is no other legal basis for processing;
- in cases where a data subject objects to processing and there are no prevailing legitimate interests;
- in cases in which personal data was unlawfully processed;
- in cases in which personal data must be erased for compliance with a legal obligation;
- personal data was collected in connection with the providing of services of the informational community under the Union’s law or the domestic law governing the controller.
Following a request for data erasure, the Owner may anonymize such data (thus depriving it of its personal nature) and may continue the processing under these circumstances for statistical purposes.
(e) the right to the restriction of processing to the extent that:
- a person challenges the data accuracy, for a time interval that allows us to check the accuracy of such data;
- the processing is unlawful, and the data subject objects to the erasure of personal data, requesting for a restriction of its use instead;
- the controller no longer needs the personal data for processing purposes, but the data subject requests such data from it for the establishment, exercise or defense of legal claims; or
- the data subject objected to processing (for purposes other than for direct marketing), for the time interval while we check whether the controller’s legitimate rights prevail over those of the data subject.
(f) the right to data portability, i.e. (i) the right to receive personal data structured, commonly used, machine-readable and interoperable format, and (ii) the right to have such data transmitted by the Owner to a different data controller, to the extent that the requirements provided for by law are met;
(g) the right to object – in respect of processing operations, such right can be exercised by sending an application as indicated below:
- at any time, on grounds relating to the particular situation of a data subject, to the processing of data concerning him/her under the legitimate interest of the Owner or based on the public interest, except for cases where the Owner is able to demonstrate that it has legitimate and imperative reasons that justify the processing and prevail over the interests, rights and freedoms of data subjects or that the purpose consists of the establishment, exercise or defense of a legal claim;
- at any time, free of charge and with no justification, to the processing of data concerning him/her for direct marketing purposes.
(h) the right not to be subject to an automated individual decision-making, i.e. the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects him or her;
(i) the right to address the National Supervisory Authority for Personal Data Processing or the courts of jurisdiction, to the extent you find this necessary.
